2. Intellectual Property Rights
All artwork, designs, images, and content on this website are the sole intellectual property of David Sherwood.
No Reproduction: Purchasing an original artwork, print, or commission does not transfer copyright. You may not reproduce, scan, or resell the artwork for commercial profit.
Social Media: You may share images of your purchase on social media, provided credit is given to the artist.
3. Print-on-Demand (POD) Products [1]
Some items on our store are manufactured and shipped by third-party Print-on-Demand partner, Prodigi.
Fulfillment: Because these items are custom-made to order, production times may vary from original artwork.
Variations: Minor color variations may occur between your screen display and the physical print due to monitor calibrations and printing processes.
4. Commissions & Custom Artwork
By purchasing a commission, you agree to the following workflow:
Deposits: A 25% non-refundable deposit is required before work begins.
Approval: We will provide progress updates. Once you approve the final digital preview, the remaining balance must be paid in full.
Shipping: Commissioned pieces will only be dispatched after the final payment clears.
Cancellations: Commission orders cannot be cancelled or refunded once production has started.
5. Pricing and Payment
Currency: All prices are listed in British Pounds (GBP).
Tax: Prices are inclusive of VAT
Payment Security: Payments are securely processed via Squarespace's third-party providers (Stripe/PayPal). We never store your financial details.
6. Delivery, Customs, and International Orders
Shipping Responsibility: Original art is shipped directly from our studio. POD items may ship directly from the manufacturer. Items may arrive in separate packages.
Import Duties: If you order from outside the United Kingdom, you are responsible for paying all local import duties, customs taxes, and handling fees.
7. Consumer Rights, Returns, and Refunds
In accordance with the UK Consumer Contracts Regulations, your right to cancel depends on the product type:
Original Art & Ready-Made Prints: You have 14 days from delivery to change your mind. You must return the item in its original, undamaged condition at your own expense for a full refund.
Commissions & Custom POD Items: Because these items are personalised or custom-made to order, they are strictly exempt from the standard 14-day return policy.
Damaged Goods: If any item arrives damaged, email picturepiano@hotmail.com within 7 days with photographic proof of the packaging and product to arrange a replacement or refund.
8. Limitation of Liability
To the maximum extent permitted by English law, we shall not be liable for any indirect, incidental, or consequential damages resulting from your use of this site or products purchased. Our total liability to you shall not exceed the price paid for the specific item purchased.
